If my memory is correct, and it's been a long time ago that this applied to me (1976), but it seems that if you were out of the country for 180(?) days, you did not have to pay income tax. That was while I was in the USN on West-Pac/Indian Ocean. But, from my memory, it applied to everyone; military and civilian. I would contact the IRS and ask them. Right now the tax shelter is for the first $85K (approx) and then you are taxed normally on the rest of your income ... this doesn't mean your income starts with the first dollar after the $85K ... it means your tax rate is identiffied by your total income but is only applied to the amount you earn beyond $85K. Example: Say your net is $115K then you are taxed at a rate for anyone making that but it is applied only to the $30K ($115 - $85). There is a minimmum number of days you must be off-shore for the shelter to kick in and the full $85 is only applicable for a full year ... anything short of that is pro0rated. Even overseas companies must declare social security and retiain in from your pay and is calculated on the fulll $115K. So the answer is Yes ... you are eligbile for the tax shelter ... and you will also have times when you share the sidewalk or sand path with scorpions.and a wide variety of spiders and snakes. I knew a guy who opened a business address in India wiht a bank account to match and had his payroll auto-deposited to that account. This may be exposed as evasion if there is no actual authentic business conducted in India but if it is a legitimate on-going business then the income shown there is not subject to U.S. taxes ... it is subject to Indian. Never learned if he went to jail or not. He had planned to take at least one short vacation there each year to help throw a cover over the deception and the way India's economy has taken off ... he may just be doing some honest business and makning some big bucks Another guy bought a laundramat in Thailand and hired some women to work/run the business ... I believed he ended up marrying into the family so I'd bet he is covered. Thailand's dollar is worth quite a bit more than India's and not so far off the U.S. but still a buck goes further in either of those countire than here in CONUS..
