ENDANGERED SPECIES ACT UNDER ATTACK FROM "FLOOD CONTROL" WAIVERS!
HOUSE AND SENATE VOTE WEDNESDAY SO GET CALLS IN AS SOON AS POSSIBLE!
1. Call your Senators and tell them to vote to strike Sen. Larry
Craig's rider on the Emergency Flood Supplemental Appropriation, and
any other anti-environmental rider or ESA waiver that is attached.
2. Call your Representative and tell him/her to vote AGAINST Reps.
Pombo and Herger's H.R. 478.
3. Call the White House and tell Pres. Clinton to veto the Emergency
Flood Supplemental Appropriation if it contains any ESA waivers or
other anti-environmental riders.

We can't let Congress and Pres. Clinton get away with another "Logging
without Laws" situation, essentially gutting core environmental laws
through the appropriations process!

NO WAIVERS OF THE ENDANGERED SPECIES ACT!

THE BILLS DO:
Reps. Pombo and Herger (R-CA) have introduced H.R. 478 which would
permanently exempt the reconstruction, operation, maintenance or
repair of federal or non-federal flood control projects, facilities or
structures from the Endangered Species Act's Section 7 consultation
requirements and Section 9 "taking" prohibition.
In the Senate, Senator Larry Craig (R-ID) has attached a rider to the
Emergency Flood Supplemental Appropriation that would permanently
exempt the reconstruction, operation, maintenance or repair of federal
or non-federal flood control projects, facilities or structures,
authorized by federal, state or local law in effect during 1996 or
1997, from the ESA's Section 7 consultation requirements and Section 9
"taking" prohibition. Although worded slightly differently, the
effects of both ESA flood control waivers would be identical.
AN ESA FLOOD CONTROL WAIVER WOULD BE DISASTROUS FOR THREATENED AND
ENDANGERED SPECIES THAT DEPEND ON AQUATIC HABITATS FOR SURVIVAL.
THE ESA FLOOD CONTROL WAIVER IS UNNECESSARY AND WILL NOT PROTECT
AMERICAN PEOPLE FROM FUTURE FLOOD DISASTERS.
