If the fax came in after 5 PM, it is late.  And that does not even address the question of whether a faxed, not an original, is acceptable.

  Last night at 7:00 PM I received a faxed petition for an office.  First, statute says it must be filed with the Town Clerk by 5:00 PM but has anyone ever had a petition faxed to their office?
