I just wanted to send a warning to the other Clerk's offices around the
state regarding a potential challenge we in Stowe are facing regarding the
issuance of Civil Union licenses.
Last week a gentleman (Lloyd Lutz) contacted our office wanting to obtain a
Civil Union license by mail. My assistant explained the process to him and
stated that he would need to come in to the office, etc. He immediately
challenged us by saying that no where in Vermont Statute does it state that
he or his partner must sign the license in our presence and suggested that
we contact our Town Attorney.
I haven't done that yet, but have spoken with Bill Dalton at the Secretary
of State's Office. Bill said that we cannot issue a CU license by mail
based on the fact that we cannot certify the license by our signature if we
didn't see him or his partner sign as well. He also recommended speaking
with our attorney.
Mr. Lutz will be contacting me again tomorrow.
I wanted to let you all know in case you receive the same call. Bill Dalton
will want to be made aware of this.
