An email (see below) was sent from Cynthia Hooley of Vital Records, 2 days ago (8/25), entitled...Error in Vital Records' "Getting Married in Vermont" Handout.   Maybe it will clear up the marriage issue of "avoiding the laws of own state".  Her original email referred to an attachment but the listserv won't allow it to be included here.  Cynthia's email was addressed to each clerk individually, not a listserv posting.  Hope this helps.

Good morning,

On July 30th, a packet of "new forms pertaining to civil marriage" was mailed to you from Linda Merchant, Supervisor of Vital Records Registration at the Vermont Department of Health.  Included in that packet was a single copy of the updated, two-sided handout called: "Getting Married in Vermont Questions and Answers to Help You Plan Your Vermont Wedding".   Note, it has a date of September 1, 2009 at the bottom right.

Unfortunately, we missed a couple of statements that are no longer relevant.  In the paragraph labeled Are there any other marriage restrictions?, the following sentences should have been deleted because V.S.A. Title 15 6,  Marriage void in state of residence, was repealed as part of the civil marriage legislation: 

"First cousins, who are Vermont residents, or residents of another state where marriage between first cousins is allowed, may marry each other in Vermont.  You cannot marry in Vermont to evade the laws of the state where you live.".

Attached please find the corrected version of the handout, which applies to all marriages that will occur on or after September 1st.  Please print a copy and photocopy as needed, or contact the Vital Records Office for additional copies.
